ZYN REWARDS TERMS AND CONDITIONS

 

1.     Terms and Conditions for ZYN Rewards:

 

1.1.  By entering the ZYN Rewards Promotion (“Promotion”) all participants (“Participants”) agree that the Promotion rules, as set out in these Terms and Conditions (“Terms and Conditions”), shall apply and are binding on them.

1.2.  TLC Worldwide (Pty) Ltd (“TLC”) and Philip Morris South Africa (Pty) Ltd (“PMSA”) are collectively referred to as the “Promoters” in respect of the Promotion for purposes of these Terms and Conditions.

1.3.   The Promotion will commence on 1 May 2025 and will end on 30 June 2025, will remain as always on throughout the contractual period, all days inclusive or while stocks and/or Rewards (as defined in Section 4 below) last (“the Promotion Period”), in the Republic of South Africa.


2.     Eligibility:

 

2.1.  Participants must be 18 years or older and may be requested to provide proof hereof at the point of purchase. Participants are therefore required to be in possession of a valid identity document or driver’s license.

2.2.  The Promoters, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with this Promotion and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter this Promotion.

2.3.  Only Participants who purchase cans of ZYN at participating Engen stores in the Republic of South Africa as evidenced by the till slip and enter correctly as set out further in these Terms and Conditions, will qualify for receipt of a Reward.

2.4.  Only one Reward per Participant shall be issued.


3.     How to Enter:


3.1.  In order to receive a Reward, Participants must:

(i)             purchase a minimum of two cans of ZYN at any participating Engen store located in the Republic of South Africa;

(ii)            scan the QR on the point-of-sale sign placed at the point of purchase;

(iii)           register by entering your details on the website to which you are directed by the QR code;

(iv)          accept the Terms and Conditions and Privacy Policy (https://www.pmiprivacy.com/global/en/consumer/); and

(v)           upload a scanned copy or photograph of your till slip.


4.     Reward:


4.1.  Participants who enter the Promotion, will receive one x 2D Nu Metro Movie Ticket (“Reward”).

4.2.  There are a limited number of Rewards available for the Promotion.

4.3.  Rewards are only valid for 30 days from date of sending of the email from the Promotor to the Participant and must be used by the Participant within this period.

4.5.  Reward partner terms and conditions apply to all rewards issued to Participants.

4.6.  Standard data rates apply.

4.7.  The Reward is non-transferable and non-negotiable and cannot be exchanged for cash or other items.


5.     Reward Redemption:


5.1.  Upon finalisation of registration and subject to these Terms and Conditions, the Participant will receive an e-mail with a unique code to redeem their Reward voucher.

5.2.  The Reward voucher code and redemption instructions will be sent to the Participant by e-mail.

5.4.     How the voucher code works:

(i)             The movie ticket code received is applicable to 1 free 2D movie.

(ii)            To book your movie ticket online visit www.numetro.co.za

(iii)           View Cinema Operating times on www.numetro.co.za

(iv)          Choose your cinema/cineplex and choice of movie.

(v)           Select Nu Metro Digi ticket and process your booking.

(vi)          Your Nu Metro ticket is non-transferable and cannot be exchanged for cash.

(vii)         This movie ticket cannot be used at the VIP section at the following Cinemas: Woodlands, Hyde Park, Bedford Centre and The Glen.

6.     Data Privacy:


6.1.     By accessing the Promotion Rewards Participants consent to the Promoters sharing Participant’s personal data with any of their affiliates (being any entity controlling, controlled by or under common control of the Promotors from time to time) and participating reward partners. By participating in the Promotion, Participants acknowledge and consent to the Promoters and suppliers collecting certain personal information about the Participant for the purposes of this Promotion, including Participant’s contact details such as telephone number(s) and email address(es) and as otherwise set out in the privacy policy of PMSA available at https://www.pmiprivacy.com/global/en/consumer/ (“Privacy Policy”). The Promoters undertake not to sell, use, or share this information to, or with third parties, or for any other purpose other than related to this Promotion, or as otherwise set out in the Privacy Policy, unless Participant’s provide their prior written consent, or in the event that disclosure is required by law.

 

7.     General Reward Restrictions:


7.1.     Reward vouchers cannot be redeemed for cash in part or whole and are non-refundable, non-transferable, and non-exchangeable and the Promoter’s reserve the right to substitute any reward with another reward of similar or equal value.

7.2.     The Promoters do not guarantee any buy-back of any of the Rewards given away in the Promotion.

7.3.     The Promoter may:

(i)    extend any time limit or waive any of the Terms and Conditions (without obliging the Promoter to waive the Terms and Conditions on any further occasion or at all for any other person);

(ii)   terminate or suspend the Promotion at any time due to supervening circumstances beyond the Promoter’s control;

(iii)  substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of the Reward. The Promoter’s decision in the exercise or interpretation of any of its rights or discretions in connection with these Terms and Conditions shall be final and binding.

8.2.     The call centre is not available on Weekends and Public Holidays.

 

9.     General Rewards Terms:

 

9.1.     The Promoters reserve the right to amend the Terms and Conditions at any time in accordance with the provisions contained herein.

9.2.     In the event of a dispute, the decision of the Promoters will be final and binding and no correspondence will be entered into in this regard and for further clarity, the Promoters shall be entitled to deal with such disputes (or any failure by Participants to comply with the Terms and Conditions ) in their sole discretion, including that the Promoters shall be entitled, in addition to any other rights which the Promoters may have in terms of these Terms and Conditions, to immediately disqualify Participants from this Promotion.

9.3.     By entering the Promotion and/or accepting any prize, Participants, users and/or winners hereby indemnify, release and hold harmless the Promoters (including their subsidiaries, holding companies and affiliates), their directors, employees, agents, suppliers and contractors from and against any actions, claims and/or liability for injury, loss, damage, expense claim, or damages of any kind resulting in whole or in part, directly or indirectly, from participation in the Promotion, and/or the use, acceptance or possession of a prize, or reward, and/or participation (or non-participation) in a prize and/or reward related activity.

9.4.     The Promoters excludes all warranties (express or implied), representations and liabilities regarding the Promotion (other than for death or personal injury caused by its negligence and/or fraud).

9.5.     Participants who, in the Promoter’s sole determination, act unlawfully, fraudulently, in breach of these Terms and Conditions or otherwise dishonestly may be disqualified from participating in the Promotion and shall not be eligible to receive a reward.

9.6.     The Promoters are not responsible for any reward misrepresentation (written or verbal) on warranties by anyone / group other than TLC.

9.7.     Additional to any other rights contained in these Terms and Conditions, the Promoters reserve the right to terminate the Promotion at any time with immediate effect. If this is the case, the Promoters will provide a notice on the website where these Terms and Conditions are available (https://www.zynrewards.co.za/terms), and it shall be the responsibility of Participants to review such website from time to time in this regard. In such event, all Participants hereby waive any rights which they may have against the Promoters and acknowledge that they will have no recourse or claim of any nature against the Promoters.

9.8.     The Promoters are not liable for any technical failure that may result in an entry not being successfully submitted. Any reward voucher is accepted by a Participant at his/her own risk and the Promoters are not liable, at any time, for any defect in the reward.

9.9.     To the fullest extent permitted by law, the Promoters shall not be liable for any claims, damages or losses (whether direct, indirect, general, special, incidental, consequential or punitive), expenses or costs (including, without limitation, costs on an attorney and own client scale) or injuries of whatsoever nature (together referred to as “losses”), suffered by the Participant or any third party arising from or as a result of this Promotion (whether directly or indirectly) and/or the Participant’s participation in this Promotion.

9.10.  The Participant indemnifies and holds harmless the Promoters against any losses, howsoever caused or arising.

9.11.  The Promotion Period may be extended or curtailed at the sole discretion of the Promoters. If this is the case, the Promoters will provide notice of this on the website. All Promotion queries must be directed to ZYN Rewards customer care centre on ZYN@tlcrewards.com


10.  Exclusions and other Important Terms:


10.1.  Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 ("CPA").

10.2.  By entering the Promotion in accordance with its terms, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Qualifying Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the reward.

10.3.   The Promotion is conducted in accordance with the laws of the Republic of South Africa. Should any of these Terms and Conditions be deemed void or unenforceable, then that portion will be deemed to be deleted and the remaining rules will remain in force.
